PROPERTY DESCRIBED ABOVE
YOU ARE HEREBY GIVEN NOTICE that the State
of Arizona claims that the property described above is forfeited to the State
of Arizona pursuant to A.R.S. §§13-2314(G)(3), 13-3413(A)(3), and 13-4301, et seq. The property was physically seized on August 26, 2009. The property was seized for forfeiture on August 21, 2009. If you have not previously received notice of
its seizure for forfeiture, pursuant to A.R.S. §13-4306(C), then this is such
notice.
The Attorney for the State has chosen to
make uncontested forfeiture available pursuant to A.R.S. §13-4309. Any person claiming to be an owner or
interest holder in any of the subject property, and who contests the
forfeiture, must, within thirty-five (35) days of publication of this notice, either (a) submit a petition for
remission or mitigation to the State’s attorney, or (b) file a claim with the Court. You should not both submit a petition and
file a claim at the same time. But if
you do not timely either submit a petition or file a claim, then all of your
interests in the subject property will be forfeited.
Any petition submitted and any claim filed,
must comply with the requirements of A.R.S. §13-4311(E) and (F).

in the property may obtain the release of seized property by posting with the
Attorney for the State a surety bond or cash in an amount equal to the full
fair market value of the property as determined by the Attorney for the State
under A.R.S. §13-4306(G), except in some circumstances. If you post a bond or cash in lieu of the
property, then the bond or cash and not the property will be subject to
forfeiture. If you wish to post a bond
or cash in lieu of the property, you should contact the Attorney for the State
named above.
