LEGAL NOTICE

NOTICE OF PUBLIC HEARING

 

 

The Cochise County Board of Supervisors hereby gives notice that a hearing will be held at or after 10:00 a.m. on Tuesday, November 10th, 2009, at 1415 Melody Lane, Building G, Bisbee, Arizona to consider the following:

 

Docket Z-02-13A, Southwestern Power Group II, LLC/Bowie Power Station, LLC: A request to the Board of Supervisors for a 5 year time extension to make substantial construction progress for the Bowie Power Station, a natural gas-fired power generation plant (approved in 2002) located approximately 2 miles north of the unincorporated community of Bowie, and west of Center Street (subject parcels #’s 301-04-028, 032, 033A, 033C, 034).  The Applicant is requesting a substantial construction progress deadline date of December 31, 2015.

 

On September 24th, 2002, the Board of Supervisors approved Docket Z-02-13, a request to rezone 260 acres from RU-4 (Rural; minimum lot size 4 acres) to HI (Heavy Industry) for the purposes of legally establishing the Bowie Power Station. The rezoning was conditioned upon making substantial construction progress within 5 years from the date of approval.    On September 18th, 2007, the Board of Supervisors approved a requested revision to this substantial construction progress condition to allow the current deadline date of December 31, 2010.  The 260 acres zoned HI would revert to its original RU-4 zoning if no substantial progress is made by that date.  This deadline is consistent with the expiration provision of the Arizona Corporation Commission's Certificate for Environmental Compatibility for the power plant.

 

The properties are further described as being situated in Sections 28 and 29, Township 12 South, Range 28 East, of the G&SRB&M, Cochise County, Arizona.  The Applicant is the Southwestern Power Group II, LLC of Phoenix, Arizona.
