NOTICE OF PUBLIC HEARING

 

 

The Cochise County Planning and Zoning Commission hereby gives notice a public hearing will be held at or after 4:00 p.m. on Wednesday, November 18th, 2009, at 1415 Melody Lane, Building G, Bisbee, Arizona to consider the following:

 

Docket Z-09-06, Guerrero: This is a request to rezone an approximately 38,000 sq.-ft. parcel near to incorporated Douglas from R-9 (Residential, minimum lot size 9,000 sq.-ft) to NB (Neighborhood Business, minimum lot size 3,600 sq.-ft.) to allow sale of hay to individual customers and to store hay on the premises for those customers.  The NB Districts allow for a maximum retail sales floor area of 2,500 sq-ft. for permitted principal uses; the Applicant has proposed a sales floor area of approximately 1,600 sq.-ft.  On September 9, 2009, the Planning and Zoning commission unanimously recommended approval to the Board of Supervisors to rezone the adjacent western parcel (tax id# 408-22-020) from R-9 to NB in order to legitimize the aforementioned commercial hay sales activities.  The total site area of the two parcels proposed to be rezoned to NB is approximately 2.6 acres.

 

If this rezoning request is approved, the Applicant would apply for variances from several site development standards, including from Section 1103.04 which requires a minimum 40-foot setback from all property lines for the hay sales structure/area and a 50-foot setback from all property boundaries for livestock containment areas, per Section 1815.  Furthermore, the Applicant would seek a waiver of the Section 1804.07.C requirement for modified pavement surface in Category B Growth Areas for their driveway and parking areas to retain the compacted native soil ground cover. 

 

The subject parcel (tax id# 408-22-019) is located just east of 304 W. Crystal Ave., approximately ¼-mile west of incorporated Douglas.   It is further described as being situated in Township 24, Range 27, Section 12 of the G&SRB&M, in Cochise County, Arizona.  Applicant: Mr. Ramon Guerrero; Hector Hernandez, Agent.

 

Details of the above docket are on file at the Cochise County Planning Department, 1415 Melody Lane, Building E, Bisbee, Arizona, and may be examined during the office hours of 8:00 a.m. to 5:00 p.m., Monday through Friday.
